Business Terms and Conditions for Grand Restaurant Festival 2017
 
MauMau, s.r.o. (Ltd.) ID NO.: 27079112 (hereinafter only referred to as the “organiser”), is the organiser of the gastronomic and cultural event called “GRAND RESTAURANT FESTIVAL” (hereinafter only referred to as “GRF”), which will take place from 15 January 2016 to 28 February 2017 in selected restaurants on the territory of the Czech Republic. The organiser decides on the selection and the number of restaurants included in the GRF.
 
Within the scope of the GRF, the organiser provides (arranges) the following for individual restaurants:
  1. tasting reservations made by clients in the manner outlined below; a tasting is understood to mean the sale of food and beverages, which the relevant restaurant produces and supplies to the customer at the time and place specified in the relevant reservation that has been duly paid for;
  2. Yummy Experiences reservations, which include a ticket for travelling on the relevant means of transportation and tastings in specified restaurants;
  3. Yummy Package reservations, which include accommodation in the specified hotel, a tasting in the relevant restaurant, and possibly other experiential services;

    (all of this hereinafter is collectively referred to as a “reservation”).
 
The catering part of the GRF lasts from 15 January 2017 to 28 February 2017, inclusive. Catering services (for the period of the catering part of the GRF) may be ordered in the period from 1 December 2016 to 28 February 2017, GRF Gift Vouchers can be ordered in the period from 1 December 2016 to 20 February 2017, Yummy Experiences vouchers can be ordered between 1 December 2016 and 20 February 2017, Yummy Packages can be ordered between 1 December 2016 and 25 February 2017. GRF Gift Vouchers can be used in the period from 1 December 2016 to 25 February 2017; everything is always to be used via the website www.grandrestaurantfestival.cz (hereinafter only referred to as the “GRF website”).
 
The sale of reservations via the GRF website is executed on the basis of the following business terms and conditions.
 
It is expressly stated that the organiser only arranges a sale on the authority of, or on behalf and on the account of relevant restaurants included in the GRF or of relevant transport providers. The relevant restaurant or transport provider, not the organiser, is liable for the execution and fulfilment of the relevant reservation that has been duly paid for. In the case of the Yummy Bus and Yummi Rickshaw, the organiser is only the arranger and not the operator of the relevant means of transportation.
 
GRF clients are natural persons or legal entities who successfully register on the GRF website, select the type of service, the place and time for its provision, and order a reservation, a Gift Voucher, a Yummy Experience or Yummy Package voucher in the manner outlined on the GRF website (hereinafter only referred to as a “client”).
 
A client creates an order through communicating a request by correctly entering and sending all the data necessary for creating an order on the GRF website. The client is obliged to check the accuracy and completeness of all the information filled out in a registration form.
In sending an order, the client undertakes to abide by the rules stated in these business terms and conditions.
 
In the event that a client’s order is accepted and duly paid for by the client, the relevant purchase is assigned a unique reservation code. This reservation code will be available to the client after they register on their client account in the GRF website. In the event that a password needed for the client to log on is lost, a substitute password will be generated and sent to the address stated by the client during registration. For security reasons, it is not possible to send a password to an address other than that requested by the client.
 
Orders that have been paid for will not be refunded. It is possible to change the date of an ordered tasting at the same restaurant no later than within three days of the booked date. The type of tasting can only be changed for another of the same value at the same restaurant. The dates for a Yummy Experience or Yummy Package cannot be changed.
 
The organiser reserves the right to change the offer of tastings, including the type or composition of individual meals or the type of beverage, or the entire GRF menu in each GRF restaurant or a Yummy Experience, or the composition of services included in a Yummy Package.
 
The tasting ordered on the basis of the following business terms and conditions can not be transfered, sold or provided as a business activity of a person that have made the order. In case of such infringiment, the organiser is entitled to cancel the order.
 
The price of an ordered reservation that has been accepted by the organiser is payable within three days of ordering and not later than 24 hours before the date of the visit to the restaurant, as stipulated in the relevant reservation. The price of a Yummy Experience or the price of a Yummy Package is payable within three days of ordering and not later than within the deadline stipulated in the given case on the GRF website. In the event that the price is not paid within this deadline (i.e. credited to the account mentioned on the GRF website, which is specified for the payment of orders), the organiser is entitled to cancel the order (withdraw from the contract).
 
With respect to the relevant restaurant, the proper and timely payment of the price gives the client the right to avail of the services in the specified restaurant/hotel at the specified time and place.
 
At the restaurant/hotel, the client is obliged to identify themselves with their name, surname, and the reservation code that they obtain after paying the price in the client account on the GRF website. The organiser is not liable for any problems caused by the incorrect copying or resending of reservation codes. A reservation code needs to be kept in a safe place and its misuse must be prevented. Upon the subsequent, additional presentation of a reservation code, admission to the restaurant will not be granted, regardless of who is presenting the code.
 

The client is obliged to arrive:
  1. for tastings in the restaurant on the date and time stipulated on the relevant confirmed reservation that has been duly paid for (no later than 15 minutes after the reserved time) at the place specified in the reservation,
  2. for Yummy Experiences as per the information stipulated for the specific Yummy Experience,
  3. for Yummy Packages on the date and time stipulated on the relevant confirmed and duly paid for reservation at the place specified in the voucher (or in the information for a specific Yummy Package).
 
In the event that the client misses a stipulated time or arrives at the incorrect time, they are not entitled to the provision of alternative fulfilment in respect of the time-related nature of reservations.
 
A period of 90 minutes is reserved for the client for the consumption of a tasting. The period stipulated in the itinerary pursuant to the timetable is reserved for a gastronomic trip on a Yummy experience.
 
The price can be paid by bank transfer, by using a Gift Voucher, or with a payment card. In the course of buying an order on the GRF website, the client receives all the data necessary for making the payment.
 
Moreover, the purchase of Gift Vouchers will incur a charge of 99 CZK sent by post for the entire transaction. Gift Vouchers are only sent out on the territory of the Czech Republic by registered post to the address given while ordering the Gift Voucher. The sending of Gift Vouchers is governed by the rules of Česká pošta, s.p. (state enterprise). The organiser is not liable for the late delivery or loss of a consignment. The provisions of these business terms and conditions that are valid for reservations, including payment terms and conditions, are used appropriately for Gift Vouchers.

We do not send Gift Vouchers cash-on-delivery.

 
A Gift Voucher is identified by a number, which the holder enters into the system on the GRF website and then makes a reservation in the selected restaurant on the relevant day at the relevant time. The voucher number can only be used once. The organiser is not liable for the misuse of a voucher number. The holder of a gift voucher is obliged to keep it in a safe place, thereby preventing its misuse. A reservation pursuant to the relevant Gift Voucher must be made by 25 February 2017. The Gift Voucher loses its validity after this date and it will no longer be possible to make a reservation.

In the case of a Yummy Bus and Yummy Limousine, the organiser is not liable for the observance of the timetable or a delay with the means of transport, regardless of whether it is caused by the nature of the means of transport, the actions of third parties, or as a result of force majeure.

The organiser is not in any way liable for defects in the services provided or for any damage or any other injury caused to the client or any third party in connection with visiting the relevant restaurant or using a means of transport. All claims must always be made immediately at the relevant restaurant or with the operator of the relevant means of transport.

The organiser reserves the right to change the composition of the restaurants that are part of the Yummy Bus or Mňam Yummy Experience or the composition of services contained in a Yummy Package due to the existence of circumstances beyond the control of the organiser or the restaurant (force majeure).

By placing an order, each client:
  1. in accordance with Act No. 480/2004 of the Collection of Laws (Coll.), as amended, gives the organiser their consent to use their e-mail address and/or telephone number for the organiser’s business and marketing purposes, particularly for the purposes of sending commercial communications;
  2. in accordance with Act No. 101/2000 Coll., Act No. 40/1995 Coll. and Act No. 480/2004 Coll., as amended, gives the organiser their consent to process their personal data within the extent of their name, surname, address, date of birth, e-mail address, or other possible information provided to the organiser in connection with their participation in the GRF and for the organiser’s other business and marketing purposes for a period of five years; At the same time, the client is expressing their consent for this personal data to also be processed in its full extent and for the aforementioned purposes via third parties authorised by the organiser. The organiser is entitled to also add the client’s other personal data to this personal data. The provision of personal data is voluntary. The client has the right to withdraw their consent, namely by doing so in writing and sending this communication to the address of the organiser’s registered office. The client also has rights pursuant to Section 21 of Act No. 101/2000 Coll., i.e. in particular this pertains to the right to have access to data that concerns them and the right to supplement it, amend it, block it, or to demand that it be removed. The withdrawal of consent is effective as of the moment it is delivered to the organiser.
In submitting a reservation code upon entering the relevant restaurant, hotel, rickshaw, or bus, the client is expressing their consent to the operating rules of said restaurant or hotel as well as the rules of transportation, the instructions of the management of their operators, and associated terms and conditions.
 
The information about allergenic substances in the food and beverages is provided by the concrete restaurants.
 
Should one of the provisions of these business terms and conditions become invalid, this will not affect the validity of the other provisions.
 
The business terms and conditions become valid and effective as of 1 December 2016.
